RUSH CHARGES

Because each order is hand-crafted, the gift boxes take approximately 3-4 weeks to complete. If a quicker turn around date is desired a rush fee will be included. The amount will be determined based on time and products desired.

SUBSTITUTIONS

While GasparaFlora tries to exclusively use small-batch and local artisan businesses, these products are not mass produced and sometimes may become unavailable at the time of the order. If a product becomes unavailable we will contact you as soon as possible. If we do not hear back from you within 72 hours we will make a substitution that is of an equal or greater value and as close to the original product as possible.

PRODUCT PACKAGING

On occasion, manufacturers may change their packaging and ingredient lists. It is the responsibility of the client and guests of the client to always read labels, warnings, and directions before using or consuming a product. For most current and/or additional information about a product, please contact the manufacturer.

FOOD ALLERGY DISCLAIMER

GasparaFlora tries to generally provide food products that have allergen-containing labels. However some products do not contain the warnings or may not be labeled. Such product always have the risk of possible allergen contamination. All clients and their guests are encouraged to read the labels before consuming. GasparaFlora will not assume any liability for adverse reactions to food consumed including labeled and non-labeled food products.

ARTISTIC VARIANCE

At GasparaFlora we treat each box as a work of art. As such there are often slight variances in the way each box may look, but we try to make each box as similar to the client’s desire as possible. GasparaFlora will not be responsible for small variances in the esthetics of the gift boxes.

MARKETING

GasparaFlora reserves the right to include a business card and/or insert card inside each gift. We also reserve the right to publish finished products on social media, industry blogs, our website, and advertising material.

RETURN POLICY

Because each order is sourced and custom-built just for you, all orders are final sale and non-refundable. If your order arrives and you’re not satisfied, please contact us immediately and we will work with you to make sure you are completely satisfied.

SHIPPING/DELIVERY

Because we want to make sure your gift arrives in perfect condition, accurate and complete delivery information is required to avoid additional fees as well as delays in your order. If an item is returned to us due to incorrect delivery address or recipient refusal, we will charge a re-delivery fee. We cannot provide a refund on delivery or shipping charges. We are not responsible for packages unclaimed or stolen from a shipping service. If packages are returned, we can arrange to have the gift sent to an alternate address for an additional shipping fee. We do not offer refunds because a package was not claimed by your recipient. If you would like to request a signature for your package, please let us know at the time of your order so we may include the extra charge in your order.

DISPUTES

You and GasparaFlora agree that any claim or dispute between the parties, shall be determined exclusively by binding arbitration. Both parties hereby covenant not to file a lawsuit against each other in contravention of this agreement.

DAMAGES

We will work our absolute hardest to prevent any damages from occurring to your order. In the unfortunate event of damaged products we must receive notification within 48 hours of delivery. For products damaged during shipping, please keep all original packing material for courier inspection in order to file a claim with our shipper.

CUSTOMIZABLE ITEMS

All customizable items (i.e. personalized tags or sticker, custom printing, etc.) included as part of an order will be printed exactly as they are submitted by the customer. It is the customer’s responsibility to ensure that all submissions are correct. GasparaFlora is not responsible for any misspellings, typographical errors, omissions, or any other inaccuracies in submissions provided by the customer.

CHANGES TO PRICES AND SERVICES

Prices for our products and services are subject to change without notice. We reserve the right at any time to modify or discontinue our service (or any part thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of our services. We reserve the right to discontinue any product at any time.

This agreement shall be binding upon the parties, their successors, assigns and personal representatives. This agreement shall be enforced under the laws of the State of California.
